Terms and Conditions
Interpretation 1.1 In these Terms and Conditions of Sale: ¡°Seller¡± means QQ Discounts Pty Limited (ACN 085 040 615); ¡°Buyer¡± means the purchaser of the items listed; ¡°Goods¡± means the products listed and specified; ¡°GST¡± means a Tax under a ¡°GST Law¡± means the same as in the A New Tax System (Goods and Services Tax) Act 1999; ¡°Deposit¡± means the amount specified overleaf and the amount paid by the Buyer as a deposit for the Goods; ¡°Balance¡± means the amount specified overleaf and is the Purchase Price less any Deposit paid by the Buyer; ¡°Delivery Date¡± means the date for delivery as specified; ¡°Order¡± means the order submitted by the Buyer the Goods by executing this document. 1.2 Nothing in these conditions will be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any conditions, warranty, guarantee, right or remedy by law (including the Trade Practices Act 1975) and which by law cannot be excluded, restricted or modified.
Terms and Conditions of Sales 2. The Goods and any other products sold by the Seller are sold on the Terms and Conditions of Sale. Free from defects and Notice of damage or defects 3.1 Subject to sub-clause 3.2 and clause 4, the Seller guarantees to the Buyer that the Goods are free from defect in material and workmanship under normal domestic usage. The Seller agrees to repair or replace subject to clause 12 and 13. As determined at the sole discretion of the Seller, any Goods found to be defective in either material or workmanship and this guarantee will subsist for a period of 12 months from the date of the purchase of the Goods to the Buyer and this Guarantee will not be reactivated by any repair or replacements of the Goods. 3.2 The guarantee referred to sub-clause 3.1 does not apply whatsoever to any defect or damage to the Goods which were specifically drawn to the Buyer¡¯s attention prior to the Buyer placing the order.
Factory Second-hand Goods 4.1 The Buyer recognizes that the Seller sells the Buyer not only new goods but also factory second-hand goods that may have some damage or defects on the surfaces like scratches or dents. 4.2 The Buyer may not refuse to accept or may not claim to return or replace the factory second-hand goods by reason of any damage or defects to the Goods recognized by the Buyer prior to placing the order.
Payment 5. The Purchase Price is payable as follows: (a) By payment of the Total on the date of the Order (b) All necessary customer information must be specified prior to payment processing (c) Orders that are processed on the weekend or during public holidays will not begin until the next available business day. (d) Payment by Pay Pal¢â are to be processed in Australian Dollars. (e) The Seller may require more information from the Buyer for additional security reference checks. (f) All Payments are inclusive of GST upon transaction.
Ownership 6.1 Property and ownership in the Goods passes upon the Buyer¡¯s payment of the Purchase Price to the Seller. 6.2 In the event of payment by Electronics Funds Transfer (EFT) or Pay Pal¢â, payment will not be deemed to be received by the Seller until the payment has been cleared by the bank. 6.3 Furthermore, the Buyer irrevocably authorizes the Seller its agent and/or assigns to repossess the Good without any prior notice to the Buyer and enter any premises for the purpose of such repossession in the event that the Buyer fails to make any payment when it is due or commences to be wound up or is placed under official management or suffers a receiver or manger to be appointed or becomes insolvent or commits and act of bankruptcy or in the event that, in the sole opinion of the Seller, the payment of any such amount in respect of the Goods supplied by the Seller is put at risk.
Legal Age to Transact 7.1 Buyer¡¯s are required to be over the age of eighteen (18) years old to place orders. 7.2 By adhering to these terms and conditions the buyer acknowledges that you are over the age of eighteen (18) years old. 7.3 If QQdiscounts P/L should suffer any damages or losses as a result of a minor, QQdiscounts P/l reserves the right to seek compensation of such losses from the parents or guardians of the minor.
Delivery 8.1. The Seller will use its best endeavours to ensure that the Goods are delivered to the Buyer on the Delivery Date provided however that the Seller will be under no liability whatsoever should delivery not be effected on the Delivery Date. Deliveries may take up to 10 days and is dependant on payment systems and coordination of transportation. 8.2 The Seller will not be responsible whatsoever for any loss of profits, penalties, expenditure, damages or losses (including consequential losses) incurred by the Buyer as a result of any delay in the delivery of the Goods. The Buyer will not be relieved from any obligations to accept or pay for the Goods by reason of any failure by the Seller to deliver by the Delivery Date. 8.3 The Buyer may not refuse to accept or may not claim to return or replace the factory second-hand goods by reason of any damage or defects to the Goods recognized by the Buyer prior to placing the order in accordance with sub-clause 4.2.
Delivery Charge 9. If Delivery Charges are specified on the Order then the Buyer agrees to pay the Seller the Delivery Charges in addition to the Purchase Price. Risk 10. Risk in respect of the Goods will pass to the Buyer immediately upon the delivery on the Goods to the Buyer.
Exclusion of the Seller 11. The Seller is not liable to the Buyer in contract or in tort arising out of, or in connection with, or relating to: (a) the performance of the Goods or any breach of these conditions; (b) any fact, matter or thing relating to the Goods; or (c) any error (whether negligent or in breach of contract or not) in formation supplied to the Buyer or a user before or after the date of the Buyer¡¯s or user¡¯s use of the Goods.
Returns 12.1 Subject to sub clause 3.2 and clause 4, the Buyer may claim to return the goods with RA (Return Authorisation by calling service centre) within two full days from the date of purchase by reason of inherent defects in material or workmanship. The Seller may in its absolute discretion as to whether the goods to be refunded or not. 12.2 When the Seller determines the goods to be returned, the Buyer must bear freights and any responsibility for returning the goods. The Seller will not accept any responsibility for returned goods lost or damaged in transit. 12.3 After two full days from the delivery the Buyer may not make a claim to return the goods at any reason. 12.4 In the event that the Buyer demands to cancel the order without inherent defects in material or workmanship the Seller is entitled to retain the 10% of the Purchased Price as compensation for the loss and damage suffered by the Seller as a consequence of any such cancellation.
Replacements and Warranty
13.1 No Refunds, credit or replacements are offered if the Buyer has changed their mind over the product purchased, made an incorrect choice, or failed to verify accurately provide information when placing an order. 13.2 Within two full weeks from the date of purchase the Buyer may make a claim to replace the goods by reason of inherent defects in material or workmanship with RA (Return Authorisation by calling service centre). The Seller may in its absolute discretion as to whether the goods to be replaced or repaired. 13.3 For the period of 12 months from the date of purchase of goods the Buyer may make a claim to repair the goods under the conditions of warranty set out below.
Governing Law 14. The Terms and Conditions of Sale will be governed by the laws of the State of New South Wales and the Buyer and the Seller submit the exclusive jurisdiction of the Courts of New South Wales.
Personal Details
15. By placing and order and/or making a purchase, you agree that the Seller may store, process and use the data collected to process your order. The Seller may then utilize your data to acquire further reference checks if required. Your details will remain anonymous adhering to the Privacy Act 1988. Return Authority Numbers
16. A Return Authority Number (RA) is required to identify your product with your request of replacement or warranty job issue. You will receive a RA number either via the QQdiscounts Service Centre or e-mail. Once you have an RA number, please attach this number to your product and follow Warranty Procedures.

WARRANY PROCEDURES
Please refer firstly to the Owner¡¯s Manual to ensure that you have followed the correct installation and operating procedures. In particular, please refer to any trouble shooting guide that may have been supplied with the product. 1.1 Verify whether warranty type in your purchase document is ¡°QQdiscounts¡± or not. If the type is ¡°QQdiscounts¡±, call QQdiscounts Service Centre. Otherwise, you are required to contact a relevant manufacture¡¯s service center. 1.2 In order to make a claim for the warranty, you should present the warranty sheet and the original purchase document, which enable us to check your eligibility for the warranty. Moreover this will enable faster and more efficient processing of your service request.
WARRANTY TERMS AND CONDITIONS
Term 2. The warranty runs for the term that is covered for 1 year from the date of purchase. Warranty 3. The warranty is in addition to any non-excludable statutory rights you may have (including under the Trade Practices Act) 4. The warranty is applicable to the product with type ¡°QQdiscounts¡±. 5. The warrant ceases if: a) The product ceases to carry the QQdiscounts serial number or sold at auction; b) The product is repaired, serviced or interfered with (in any way) other than by QQdiscounts Pty Ltd; c) The product is damaged by: - normal wear and tear; - accident; - misuse; - failure to properly maintain and service; - infestation by insects or vermin; - incomplete installation and in correct operation; - excessive use, use for which the product was not designed to be used, use of faulty or leaking batteries; - Incorrect voltage including power surge from foreign sources such as main power, antenna or cables connected form other units. d) The product is rented; or e) The product is used in a commercial environment or use other than a normal, domestic environment (with the exception of computer-related equipments or facsimiles). 6. This warrant does not apply to any accessory (including any consumable-detailed in manual booklet) supplied with the product. 7. This warranty does not apply to dead pixels on LCD panel products. Claim 8. If you wish to make a claim under the warranty, please contact the QQdiscounts Service Centre. 9. Within Sydney Metropolitan Coverage a) If the Product you are claiming meets the following conditions, on-site warranty by our technicians is available: i. The product shall be a CRT Television of 59cm screen size or over, a refrigerator with a gross capacity of greater than 100 liters, an air conditioner, or a washing machine. 10. Outside Sydney Metropolitan Coverage a) A designated Authorized Service Agent will be scheduled to provide on-site warranty by trained technicians; i. The product shall be a CRT Television of 59cm screen size or over, a refrigerator with a gross capacity of greater than 100 liters, an air conditioner, or a washing machine. 11. Otherwise, you are required to deliver and send the product to and from the QQdiscounts Service Centre Located in Sydney Metropolitan Area at the cost of the Buyer. 12. Even in the event of on-site warranty, service charge may apply if there is no technical issue addressed. 13. Service charge may apply for any service work that are or are deemed to be outside the warranty terms and conditions as stated above.
